Enakmen Ugama Bukan Islam (Kawalan Pengembangan Di Kalangan Orang Islam) 1988 adalah undang-undang sivil yang boleh dikenakan ke atas mana-mana penduduk Selangor tanpa mengira bangsa atau agama.
Seksyen 9 enakmen tersebut adalah berkaitan kesalahan berhubung dengan penggunaan perkataan-perkataan dan perbahasaan tertentu yang bersumber Islam. Undang-undang ini yang diluluskan pada 4hb April 1988 [DUN. Sel. 30051/45; PU. Sel. 1545 Sj. 18.] sudah lama diwartakan dan sememangnya sedang berkuatkuasa.
Perbahasaan yang tidak boleh digunakan oleh orang bukan Islam berkaitan dengan agama bukan Islam adalah seperti berikut:

Ong Kian Ming ialah Ahli Parlimen Serdang, Selangor.
Dia seorang evangelista bongkak yang begitu licik dan pandai bermuka-muka.
Sekiranya seseorang Wakil Rakyat itu didapati bersabit kesalahan oleh mahkamah and dikenakan denda sebanyak RM2,000 atau jumlah yang melebihi amaun tersebut, dia boleh dibatalkan kelayakan serta dilucutkan jawatannya.

I read that to mean using the words in context of other religious purpose such as ” Insya Allah ada tazkirah di gereja esok” or “alhamdulillah my anak malaysia children have been baptised” but not in the context that the YB was using.
thank you for sharing this piece of information Helen Ang. Religion is not a Joke… not something we make fun off. We are not the Mat Sallehs who ridicule every thing under the sun. Our values and their values are different and i personally like to keep it that way.
Modernisation doesn’t mean giving away our culture and values. I am a proud Malaysian with the vast heritage that we have and values that we still believe in. i read a posting on facebook last nite reminded us of our rukun negara… Kesopanan dan Kesusilaan! I have no idea such a thing is illegal. Now that you pointed it out, I really like to see if the Pakatan led state would do anything about it.

The enactment was mentioned in the news following the Sultan’s titah on ‘Allah’ a few days ago.

Just a few questions here:-
1. Is the Enactment really a piece of civil legislation enforceable on the non-Muslims? I thought it was a piece of state Islamic legislation and as such, it has no effect on the non-Muslims. I have not heard of anyone being prosecuted, fined or jail under this enactment, especially on the prohibition of using certain words.
2. If the legislation is indeed enforceable on the non-Muslims, then why is the non-action against MP OKM? What is MAIS or JAIS doing? Where is Perkasa branch of Selangor?
(A) The enactment was passed by the Selangor state assembly and therefore it is a civil piece of legislation.
Article 11 (4) of the Federal Constitution has given the state authority through the State
Legislature to enact laws to control the propagation of non-Islamic religions or beliefs to Muslims.
At present, most of the states, such as Perlis, Johore, Kedah, Kelantan, Negeri Sembilan, Pahang, Perak, Selangor, Terengganu and Malacca, have exercised their powers through their
state enactments to legislate laws relating to the control of non-Islamic religion among Muslims in their respective states. Kelantan was the earliest state to do so in 1981, and Johore was the last, in 1991. However, the states of Penang, Sabah and Sarawak do not have such an enactment. State legal provisions are as follows:

Jadi kalau sabit kesalahan, kita dapat pilihanraya kecil….
The penalty for the said offence (misuing the word ‘Allah’) is, alas, only RM1,000.
But he did tweet it four times separately, so maybe he can be slapped with four charges (RM4,000 totalled).
