“MAIS tidak mahu memulangkan (Bible), pastinya ada alasan yang konkrit. Dalam mesyuarat MAIS itu saya pun ada, jadi apa yang diputuskan MAIS memang satu keputusan yang menyeluruh,” tegas Mufti Selangor Tamyes Abdul Wahid mengulas tindakan MAIS untuk meneruskan kes berkenaan di mahkamah.

“Saya percaya Jabatan Agama Islam Selangor (JAIS) dan MAIS bertindak mengikut enakmen dan bidang kuasa yang ada yang termaktub dalam enakmen bukan Islam,” kata beliau.

“Tindakan JAIS bukan atas dasar cetakan Bible berkenaan di dalam versi bahasa Melayu tetapi atas dasar kalimah Allah telah digunakan di dalam Bible berkenaan dan ini mengundang kepada satu justifikasi siasatan bagi mengenalpasti samada berlaku satu kesalahan di bawah Seksyen 9 Enakmen 1988,” kata pengerusi MAIS Mohamad Adzib Mohd Isa.

“Malangnya pihak media termasuklah kenyataan pengerusi National Unity Consultative Council (NUCC) seperti yang dilaporkan dalam akhbar semalam telah melaporkan fakta yang tidak tepat sama sekali bagi menggambarkan seolah-olah tindakan JAIS adalah semata-mata kerana cetakan Bible berkenaan adalah di dalam versi bahasa Melayu,” kata Mohamad Adzib dalam sebuah kenyataan akhbar pada 9 Jan 2014.

(b) Isu pokok: Tidak wujud ruang ijtihad untuk membenarkan Kristian guna kalimah Allah

Mengikut PAS, perkataan ‘Allah’ boleh digunakan dalam Bible bahasa Melayu dengan syarat “jangan salah guna”.

Aidit Ghazali, seorang ahli MAIS bercakap dengan akhbar Sinar Harian (‘Perjelas maksud “jangan salah guna”,’ 11 Jan 2013), berkata mereka fasik jika mengingkar Al-Quran dan sunnah.

Jawatankuasa fatwa negeri Selangor telah mewartakan larangan penggunaan kalimah Allah oleh Kristian pada 18 Feb 2010. Muzakarah jawatankuasa fatwa yang ke-82 juga memutuskan bahawa lafaz Allah khusus bagi agama dan umat Islam, dan ia tidak boleh digunakan oleh Kristian.

Dalam isu tuntutan penganut Kristian, muzakarah Majlis Fatwa Kebangsaan berpendirian bahawa ia melibatkan Siasah Syar’iyyah dan faktor utama larangan adalah berasaskan akidah dan kesucian agama Islam.

“Dalam keadaan di mana agama dan umat Islam dihimpit dengan pelbagai gerakan yang cuba menghakis kedaulatan Islam sebagai agama rasmi negara, umat Islam perlu bersatu dan menunjukkan ketegasan dalam menjaga maruah agama,” kata muzakarah yang bersidang pada pada 5-7 Mei 2008.

(c) MAIS tidak bersetuju dengan arahan exco kerajaan Selangor

Mesyuarat khas MAIS pada 13 Jun 2014 memutuskan tidak bersetuju dengan keputusan Peguam Negara untuk tidak meneruskan pendakwaan terhadap Persatuan Bible Malaysia.

MAIS juga membuat ketetapan bahawa arahan exco kerajaan Selangor (supaya JAIS memulangkan semula semua kitab-kitab yang disita) adalah di luar bidang kuasa badan exco tersebut.

“MAIS dan JAIS sebagai pihak berkuasa yang bertanggungjawab memelihara kesucian agama Islam di Selangor amat peka dengan kegiatan dan usaha pihak yang tidak bertanggungjawab untuk mencemar kesucian Islam dengan menyalahgunakan istilah atau nama-nama tertentu yang berteraskan ajaran Al-Quran bagi memudahkan kegiatan memurtadkan umat Islam,” kata pengerusi MAIS Mohamad Adzib Mohd Isa.

Marina sanggup berdiri di bawah matahari terik, dengan membawa bunga sekali, demi mempertahankan gereja yang menggunakan lafaz ‘Allah’.

Di samping itu, dia juga pernah mengheret Isma ke mahkamah kerana NGO Islam tersebut telah mendakwa dirinya sebagai salah seorang dalang di sebalik Comango.

Mahkamah Tinggi pada 9 Mei lalu menetapkan bayaran kos penghakiman sebanyak RM3,000 yang perlu ditanggung oleh Marina. Menurut naib presiden Isma Abdul Rahman Mat Dali, tindakan pihak Marina meminta penangguhan kes saman adalah suatu yang amat memalukan.

Bekas pesuruhjaya PAS Selangor itu semalam menuduh exco Muslim mengetepikan kepentingan Islam gara-gara tunduk kepada DAP kerana gila kuasa serta mahu terus menduduki kerusi empuk.

    It is common knowledge that the PAS Islamists hold on to a anthropomorphic conception of “ALLAH” – the Lord of all creation. We, the classical majoritarian “ahli sunnah wal jamaah” understand the essence of God Most High to be beyond any human conceptions, beyond the circumscription of space and time, absolutely unlike the inter-dependent nature of all created things.

    The PAS Islamists largely abide by a syncretic Hanbali-Wahhabi creed which among other things, spurns the study of “mantiq” (formal logic relating to jurisprudential principles) and the discipline of tasawwuf (cultivation of ethics and mystical discipline) which have been part and parcel of Islamic orthodoxy for the last 1000 years. One wouldn’t be far from the truth to perceive that the turmoil of radicalism and the tumultuous Arab Spring have as one its root causes, this flawed understanding about Allah, and the role of the human intellect in the life of the world.

      But Allah is Transcendent above all created beings, One and Absolutely Unique, ineffable to the rational mind and its imaginations. Allah neither begets offspring nor is Allah begotten, and Allah exists in and of Himself Alone without any association whatsoever.

      If PAS did have tasawwuf the PAS ustads wouldn’t say angry things or do the kafir-mengkafir they are famous for. Likewise, if they actually did mantiq, PAS would have been a cleverer bunch. None of the hudud backflips and unstrategic decisions.

      Given the already religious state of our schools, perhaps swapping some of the agama content with either/both of them would do Malaysia good. All the hypersensitivity and radicalism nowadays is due to literalism and obsession with fekah anyway.

      The Arab Spring is a destabilizing exercise full stop. Religion certainly helped the process, but if it wasn’t religion it would be something else. Remember Arab nationalism in the early 1900’s?

    Kalau AG sudah kata ‘no case’ dan tiada pendakwaan dibuat, MAIS tiada kuasa untuk terus merampas alkitab. Macam mana boleh wujud 2 standard? Tiada pendakwaan dan pada masa yang sama, alkitab tidak dipulangkan. Wujud kecelaruan undang-undang atau ‘grey area’. Tugas MAIS adalah menyiasat sahaja. Bukan mendakwa. Dan jauh sekali untuk menghakami dan menghukum.

          BN won 86 seats in the peninsula, Pakatan won 80, only six seats behind.

          It is Sabah & Sarawak which gave BN its secure majority.

            1. The last Sarawak state election was held in April 2011. They need to have the next one by around first quarter of 2016.

              Among all the states in Malaysia, Sarawak is the one with the most Christians as a percentage of the local population.

              Also, in the JAIS raid, some bibles in the Iban language were confiscated. So the conniving evangelistas are playing up this angle to agitate the S’wak natives.

What is most important is that when the Selangor Islamic Religious Department (JAIS) confiscated those Bibles containing the special noun “Allah”, they were acting on the provisions of Section 9 of the Selangor Shariah Criminal Enactment which prohibits the use of 25 or so Islamic words and nouns in non-Muslim publications. You will be committing a crime merely by having one in your house or car, let alone propagate one to a Muslim (or more).

    What does the Shariah enactment have to do with non-Muslims, you may ask. Everything! It is NOT an Islamic law, it is a State law! Actually, it is a State Criminal Law! And a state criminal law applies to all be they Muslims or otherwise. And it is a STRICT LIABILITY law! Like I said, you have one, you break the law!

    You constitutional law sexperts may also argue that the law is unconstitutional. It may be so. But it is the state law until and until a Constitutional court decides otherwise.

      1. No point lodging police report against the AG. One has to understand how the criminal justice system in Msia works.

        1.Police will investigate and send the report to the AG.
        2. AG will evaluate and decide whether to prosecute or otherwise.
        3. In the event of prosecution, Court will adjudicate.

        No matter how many thousands of police reports or how strong the evidence, the AG will not prosecute himself. I am not a legal expert. But I think even the Court has no jurisdiction to review the legality of the decision of the AG in not framing charges against BSM. The only solution is for the Cabinet/PM to sack the AG.

        Will Najib do so?

        PS. For all the NGOs that made police report, do enjoy your few moments of fame in media coverage. You will find out later that you have wasted your time.

            We shall also see if there is any party that is willing to sue the AG in Court, i.e. to invalidate the AG’s decision of not prosecuting BSM despite the clear wordings of the Selangor Enactment 1988.

            I am putting high hopes on Islamic NGOs like JATI, ISMA, Perkasa and Pekida to do the above.

            For Syariah offences, the Ketua Pendakwa Syarie of the state has the power to decide whether to prosecute of otherwise. That is why the link said:-

            “JOM ramai-ramai kita buat laporan di JAIS berhubung kesalahan Gani ini. Jika dia sebagai batu penghalang di Mahkamah Sivil. Kita heret dia ke Mahkamah Syariah.”

            Question: Will the Ketua Pendakwa Syarie of Selangor dare to prosecute AG for committing syariah offences?

    Let us be clear on the duties of the respective parties pertaining to the Selangor Enactment 1988:-

    1. Duty to investigate – JAIS
    2. Duty to prosecute – AG
    3. Duty to adjudicate and punish – Civil Court

    The AG has decided not to prosecute as there was ‘no case’. JAIS has no basis to continue keeping the bibles. Doing so will amount to usurping the functions both of the AG and court as it will tantamount to JAIS itself playing the role of investigator, prosecutor and court.

    There is no 2 ways of doing things. Either AG frame a charge with the seized bibles as evidence, or the AG drop the case and the bibles duly returned to BSM.

    No matter how strong JAIS feels that an offence has been committed by BSM, the decision of the AG must be respected under the legal system of our country.

    1. If you’re not satisfied, get your lawyers and challenge the state Islamic authority. What ? You scared ?

        I have no interest in the matter. I can’t sue JAIS. My case will be thrown out.

        BSM has the locus standi. Get a lawyer and sue JAIS for acting beyond its authorities. Let the court draw the line between the roles of investigator and prosecutor.

        Meanwhile, JAIS should also sue the AG. Get the court to review the reasonableness of AG in dropping charges against BSM.

            In Msia, only the AG has the power to prosecute. If the AG said ‘no case’, then there is no crime no matter how strongly you feel otherwise. Who are we to say BSM has committed an offence?

            I think the court has no such power. The discretion of the AG is non-reviewable.

            Nevertheless, both of you may try to lodge police report and/or sue the AG.

      Where were their respects when they said they would continue to use ‘Allah’? Or when the ‘We are all Allah’s children’ sign (that sentence in ‘Bahasa Melayu’ reeks with insults, blasphemies, and whatnot..we know they know) was held among them? Or maybe Blackout505 was never meant to show disrespect?

  7. In principle, what JAIS did is right to defend Islam. What I don’t understand is that if the bibles are for Sarawak why they did not send the bibles direct to Sarawak. I assumed that the bibles were printed in Indonesia. There must be other motives that the Church refused to disclose.

    On the other hand, I did not like the way JAIS does its work. It has created tensions – inefficient and ineffective. What is the worst, it does not create harmony.

    There are many issues involving Muslims in Selangor. For example the issue of Wahhabi. In Malaysia the spread of Wahhabi is discouraged. In fact all meetings, workshops etc JAKIM concluded that the spread of Wahhabi is prohibited on the premise that it can lead to disunity among Muslim ummah.

    In Selangor, JAIS encourages Muslims to lodge a report. However when we make a report, almost a year yet there is no decision. In other case, there was a woman who wanted to convert to Islam. JAIS made the process difficult to follow that the woman went to other state in order to convert to Islam. Muslims normally would like to have a surau in their area of residence. I know a case that the ustaz is still waiting for the approval that takes too long though the surau is in existence for many many years.

    These are some of the examples that Muslims in Selangor do not like JAIS.

  8. What MAIS does is right. No need to return the confiscated Bibles. Imagine if MAIS released them. Those evangelists will go on proselytizing sprees. It will make Muslim’s faith in unmitigated jeopardy.

      Then AG should charge BSM using the bibles as evidence. Now AG has said no case. What basis MAIS has to continue keeping the bibles? Is MAIS trying to be another AG in Selangor?
