The Malaysian Insider dulu pun pernah fitnah Majlis Fatwa

The Malaysian Insider (TMI) is a repeat offender.

Malaysian Insider is again driving a wedge between Muslims and non Muslims and creating hatred against the Islamic authorities and distorting facts,” wrote blogger Ellese last year on 18 April 2014.

TMI said:

“Hours after the death of Karpal Singh, Muslims were told by the National Fatwa Council today they were not encouraged to use the phrase ‘Rest in Peace’ (RIP) to a non-Muslim because the term had Christian connotations.”

“This is a blatant lie to incite unjustified hatred,” said Ellese. “They purposely gave a false impression that the majlis fatwa is somewhat targeting against those wishing farewell for Karpal. Really blatant lie.”

Please remember that TMI does this kind of thing (as their agenda) ALL THE TIME. They’ve got the worst track record among all the Malaysia media for fitnah and they’ve been getting away with it for far too long.

Wisma Putra must censure Australian media on its slander of Fatwa Council

Articles in the Sydney Morning Herald and its sister paper The Age today claim that Malaysia’s fatwa council does not allow ‘Rest in peace’ to be said for Karpal Singh.

The two Australian papers also said that the council’s statement had come “at a time of mourning over Mr Karpal’s death”.

No such fatwa even

The statements by Fairfax Media (owner of both papers) South-East Asia correspondent Lindsay Murdoch are inaccurate.

Murdoch alleges that:

(1) Malaysia’s fatwa council does not allow RIP to be said for Karpal Singh.

(2) The council’s statement was issued at a time of mourning over Karpal’s death.

There is simply no such fatwa either this year (screenshot below) or anytime in the past.

According to blogger Ellese who revealed the truth of this matter, what there is is a Q & A column featured in the e-fatwa website that answers queries from members of the public.

Advice guidelines are not fatwa

Given its date of publication more than four months ago, the hukum clearly has nothing to do with the DAP former chairman’s sudden demise a couple of days ago. As such, the accusation by both Australian papers that the Malaysian Islamic council “does not allow RIP to be said for Karpal Singh” is off mark.

An unnamed Jakim official providing guidance on the use of RIP by Muslims in Malaysia does not equate an official fatwa which is one that has to be gazetted to have the force of law.

A fatwa is a serious matter determined by the council muzakarah when commanded by the Yang di-Pertuan Agong or over a issue of public importance raised by the Mufti(s). Note that there is no name, belonging to any of the Malaysian state muftis, attached to the December 2013 hukum RIP article which carries no byline. (Therefore it is not a fatwa.)

It is further mischievous for Murdoch and his papers to imply that our religious authorities somehow imposed this RIP prohibition in direct response to the deceased because Karpal was a “high-profile opposition figure” who has “paid a heavy price for speaking out against his country’s ruling party and defending human rights”.

The Malaysian Insider (TMI) is legendary for some of  its deliberate misrepresentation. Its bad reputation precedes it and Lindsay Murdoch has been remiss in the discharge of his journalistic duty to have picked up his story lead from the sleazy ‘news’ portal to begin with.

TMI is notorious for its malice, its countless “apologizes” to prominent personalities (among them Mukhriz Mahathir and Dr Mahathir Mohamad) and being slapped with a RM200 million libel suit by tycoon Tajudin Ramli aside from many complaints about its moderators removing certain pro-government readers’ comments as well as countless complaints with regard to its agenda-driven censorship of pro-BN reader feedback.

In fact, TMI created local journalism history by having once had to issue FOUR! apologizes in the space of a little over a week.

Malaysia’s most pro-Christian publication

Rightly taking TMI to task for “distorting facts”, blogger Ellese – who had been the first to expose the portal’s sleight of hand – said: “They purposely gave a false impression that the majlis fatwa is somewhat targeting against those wishing farewell for Karpal. Really blatant lie”.

Ellese also highlighted how TMI provided a ‘fatwa’ link that did not lead to the [purported] content it had cited. I too have also personally caught TMI turning the identical dirty trick once before on another topic.

Ellese added that TMI is “unethical” and “purposely misleads to create hatred”. Ellese is absolutely right. Legions of political bloggers share this view and TMI has been called out many times before in Malay blogosphere by numerous bloggers.

Even after the brazen Malaysian Insider editor(s) were caught lying, they buat tak tahu. So sneaky!

      On this one, TMI is mucking around with a very high and powerful federal religious authority comprising state muftis, who are reps of the Sultans. The council has 3 Tan Sris, 12 Datuks, 7 Professors and a handful of PhDs in their ranks.

      Some of them are battle-hardened, such as Perak Mufti Harussani Zakaria, and won’t take the TMI‘s rubbish lying down.

      Just like the Dapsters, TMI the pro-Christian portal only bullies guys (like their reader-commenters, independent bloggers, and those who are targets/victims of the evangelista hatchet job) who are smaller than them.

      The National Fatwa Council which is under Jakim which is under JPM is not the usual small fish that the bully boys of TMI can easily fry.

      I believe that TMI has met its sepandai-pandainya tupai melompat moment.

    Never ever just read an article (from any source) & make your judgement blindly without doing a more in-depth research from various resources. You have to think clearly before you express your personal feeling in social media coz it’ll definitely stir-up things more.

    KJ should tell Malaysian Insider and The Sydney Morning Herald to shut up because Malaysian Insider and The Sydney Morning Herald do not have the rights to criticize or condemn the Majlis Fatwa.

    If the writer of Malaysian Insider’s article is a Muslim, he must respect and listen to the Majlis Fatwa and not write an article to make people who do not understand Islam or the haters of Islam condemn Islam as they wrote in their comments.

    The Sydney Herald’s writer has no rights to interfere in other people’s religion and other country’s internal affairs. He must not write about things that he does not understand.

    1. The advice against Muslims saying RIP was taken seriously enough to be published by two very established Aussie papers.

      TMI was deliberately inciting, and the damage has been done. The misrepresentation has been spread and the negative impression created.

      As Ellese has pointed out, even the Editor’s Note is a lie. It said that TMI “implied” the fatwa was given a few hours following, and in response to Karpal’s demise.

      It wasn’t just “implied”. It was explicitly stated. TMI is a proven shit-stirrer.

                1. People who claim that the trinitarian God is not found in the Bible are clearly biased and have no idea what they are talking about. Quite often, these people are Muslims as it doesn’t fit in with what the Prophet revealed. But having studied the Bible in depth, it’s ludicrous to question the validity of the Trinity when it’s there to be found in both the Old and the New Testaments. I suggest Muslims should educate themselves on Christianity by studying the Bible, not just the Quran before making such uneducated and false statements about a religion that they know very little about.

Millions of brilliant Catholic, Christian and lay scholars throughout the centuries have had no issues with the trinitarian concept of God, based on Christian tradition and scripture.     ‘Why does IGP get to decide what’s seditious? Marina Mahathir asks after TMI 5 arrests’ – an article in The Malay Mail yesterday.

    The news portal quoted Marina as saying, “Very sad day for media freedom, as limited as we already had. How come IGP gets to decide who is seditious and who is not?”

    Well, if not the Inspector-General of Police, then who? After all, it is Khalid Abu Bakar who represents the power of the authorities as the country’s top law enforcement officer.

    So yeah – to answer Marina’s question – indeed he gets to decide on THE INVESTIGATION of “who is seditious and who is not”. Being the PM’s consultant in NUCC, Marina ought really be more knowledgeable about these things.

    Yup, the IGP decides on who the police want to investigate for sedition, the Attorney-General’s Chamber decides on whether to press charges while the court will decide on whether the accused is guilty or not.

    And no, the arrest of Ho Kay Tat, Jahabar Sadiq and Gang is not a “[v]ery sad day for media freedom” as claimed by Marina. Not at all.

    It is a day most welcomed as the agenda-driven TMI has been terrorizing Malaysians through their patently false reports, concocted from thin air, and their character assassination of innocent victims.

    When contacted yesterday, Marina told The Malay Mail, “If the report is inaccurate, then there should be official statement on it. TMI would lose some credibility”.

    The truth of the matter is, TMI simply refuses to correct their maliciously faked copy, even when the request comes from the Prime Minister’s Office itself.

    Below are the PMO tweets on 25 March 2015 complaining about TMI’s deliberate misrepresentation of a part of the PM’s speech. TMI put words in Najib Razak’s mouth that he never uttered.

    PMO statement:

    “We wld like 2 clarify an inaccurate story by The Msian Insider today. PM @NajibRazak did not say Sedition Act is needed 2 curb terrorism.”

    “In his speech, PM @NajibRazak said: ‘We also prioritise racial & religious harmony, that is why we need to strengthen the Sedition Act’.”

    “Despite our request to correct the story, The Malaysian Insider has yet to do so.”

    If the PM himself is unable to obtain redress/correction from TMI for its deliberate misquote, then how would the rest of us mere mortals fare when we are bullied and smeared by the TMI lying and spinning machine?

    It was widely reported that TMI had committed “suatu provokasi fitnah yang sangat jahat sekali ke atas institusi Kesultanan Melayu”.

    According to a report in the Malaysia Aktif portal, the Council of Rulers expressed their “kemurkaan yang amat sangat”. See ‘Tindakan Tegas perlu dikenakan terhadap Portal Malaysia Insider’ article on 26 March 2015.

    Malaysia Aktif reported that the Council had taken to task TMI for “mencemar ketinggian darjat dan martabat ke Bawah Duli-duli Yang Maha Mulia Sultan dan Raja-raja Melayu”.

    “Majlis Raja-raja Melayu menafikan sekeras-kerasnya artikel berkenaan dan tidak pernah membincangkan mengenai pindaan Perlembagaan berkenaan pelaksanaan hudud sebagaimana yang ditulis.”

    The Keeper of the Rulers’ Seal proceeded to lodge a police report on March 26 saying that the TMI report is false.

    Isma in its March 31 article pointed out that despite all the brouhaha, TMI still yet chose to display the false and malicious story in its website for a week. – “Sehingga berita ini ditulis TMI terus mengekalkan laporan mengaitkan Majlis Raja-Raja dengan hudud dalam ruangan ‘MOST READ THIS WEEK’.”

    The Malay Mail story further quoted Marina as saying that the “heavy-handedness makes people sympathise with TMI, especially since it’s the latest in a long line of arrests”.

    It also said that Marina believes, “If you arrest people for voluntarily coming forward to aid in investigations, what incentive is there ever to help the police?”

    Those who sympathise would sympathise regardless. Even after TMI‘s credibility has been torn to shreds, it makes no difference simply because some Malaysians are so partial and partisan due to the ABU-ABU-ABU politics that they’ve lost their moral compass.

    Marina’s statement on “what incentive is there ever to help the police?” is certainly typical of her ‘Liberal Doses’ persona.

    She is now going on a Twitter overdrive tweeting her support for press freedom vis-à-vis TMI.

    The crux of the matter is not the freedom of the press. TMI, which has a long track record of cheating and lying is no paragon of press freedom.

    In fact, TMI‘s abuse of the media went so far as to include the publication of a doctored photo that cast the PAS president in a bad light. A banner carried during a recent ‘Free Anwar’ demo was Photoshopped to say “Undur Hadi” when the actual wording had referred to somebody else.

    And Marina seems to harbour double standards. Freedom of the press was not on her mind when she was so very quick to sue Isma for linking her – in her capacity as a director in Sisters in Islam – to the Comango faith freedom initiative.

    In fact, Marina also threatened to sue any website or blog that reproduced the Isma flyer which had her name on it.

    The issue with TMI is misrepresentation and defamation. Its editors were hauled up to be investigated on the charge of publishing seditious material that has the tendency “to bring into hatred or contempt or to excite disaffection” against the Rulers.

    Pakatan media have been spinning as if there was only a careless and forgivable mistake contained in the TMI article. This is so sneaky.

    The entire TMI article is a complete fabrication. Our nine Sultans, Raja and Yamtuan Besar have rebutted the article as false.

    Hence Marina’s Bangsar Malaysia posturing against the IGP does her no credit.

    1. Most the urban readers, particularly the oppo-friendly, see this TMI issue as one that concerned freedom of speech/press. TMI should be taken to task for publishing lies.

      But the majority of the non-urban (kampung, if you will) people see this as “derhaka”, not of the Jebat variety, but still biadap towards the royal institution. This is viewed in light of all the other biadap attitude towards the institution, which must surely indicate that more are questioning the position of royalty in the constitution. It has been going on since before GE13 and it’s getting worse because the authorities seemed to be unable to act on this.

      I read some comments that said action should be taken on TMI for defamation. Surely, people do not expect the Royal institution to file a civil suit for defamation. The fact that the Keeper of the Rulers’ Seal had to file a police report is already laughable. Is the Royal Institution like a regular office that they need to file police reports? Isn’t it the duty of the government of the day to safeguard the position of the Royal Institution in the Constitution?

      Maybe we who live in the non-urban areas are not as suave and polished as people think but we at least know and hold sacred the constitution.

              Rulers are not the only class that enjoy the protection under the Act. Other classes such as the various ethnics also enjoy the same.

              Why the lack of police action under the section above against pro-government personalities that have made such seditious statements or news in the context of ‘pendatang, tutup sekolah vernakular, bakar kitab, tutup kuil etc’?

              Again I stress my point here. Police acted in a double standard manner. They are fast to take action on anti-government personalities under the Act but not on pro-government personalities.

                  Sedition Act does not take into account the intention of the statement maker. No intention and real impact arising from the statement need to be establish under sedition. Read Section 3(3):

                  It basically provides that “the intention of the person charged at the time he did or attempted (the seditious statement) shall be deemed to be irrelevant if in fact the act had, or would, if done, have had, or the words, publication or thing had a seditious tendency.” (the real provision is too long to be cited here)

                  Read together with Section 3(1)(c):

                  A “seditious tendency” is a tendency—

                  (c) to promote feelings of ill will and hostility between different races or classes of the population of Malaysia; or

                  Take the example of ‘bakar kitab’ statement. My opinion:

                  1. No actual kitab needs to be burned in order to consider the statement as seditious.
                  2. Subsequent clarification by the statement maker is ineffective to negate/deny the content of the original statement.
                  3. Not necessary to prove that there were Christians that were offended by the statement.
                  4. Just need to look at the wordings of the statement and see whether the statement has a “seditious tendency”.

                  It is my opinion that the statement of ‘bakar kitab’ is seditious. Not Mahathir, police or minister can exonerate the statement maker. The least the police can do is to investigate the case, pass the papers to AG for prosecution and let the court to decide according to the law. The statement maker can defend himself at court. It is the court that can absolve the statement maker.

                  Problem is we have selective prosecution and double standard. The police, minister and even the AG had already absolved the statement maker by refusing to proceed further. The due process of law does not take place.

Mukhriz had to initiate his own action to demand apology from TMI. There is a difference between sedition and libel/defamation/slander.

Read Section 3 of the Act for the definition of ‘seditious tendency’.                       I am not defending the TMI article. Anyway, the due legal process has already taken. Let TMI defends itself at court in the event of prosecution.

                      What I am questioning here is the double standards of the police. No action is taken on pro-government personalities that have made/uttered seditious statements. What the police did is merely recording the statements from these personalities. Thereafter, NFA – No Further Action.

          2. Can’t help you if you fail to see the bigger picture. This is a portal that falsely lay some statements at the door of the ROYAL INSTITUTION without even consulting with the institution. Tis is not just false reporting. This is attacking the royal institution.

            I don’t know but I think part of the problem is because they are collectively called Majlis Raja-Raja Melayu. Maybe that’s why some Malaysians fail to see their position in the constitution as the head of the Federation but instead only see the word Melayu which is anathema to them.

            In this context of “attacking” the royal institution, I think we can safely say it’s only been done by TMI and no other media organisation.

    Most of them likely Msian Chinese with a smattering of Sporean chinese. Its all about how much better as a leader Lky was not taking into account the difference in size n population. How they wished Msia had a leader like Lky now instead of Najib.

    Is that not ironic? A leader like Lky would probably sue the pants of the Opposition for their lies n halfTruths and most likely haul their asses to prison for a loooong time. And he would definately not tolerate those silly useless demos the Pakatan seem to love.

  16. I am in Singapore for a business trip and the front page news in the Straits Times news was the arrest of the TMI five. The ST as a matter of factly stated that the govt has been arresting more than 100 people who had been critical of Najib. How this can be published with the Malaysian High Commission protesting, I don’t know. I bet that if any Malaysian newspaper say anything bad about Singapore, the HC will immediate respond the same day ensuring their replies are published immediately. Our HC is sleeping while Dapters in Singapore expand the anti-BN propaganda to the city state. Their coverage of GST and 1MDB issues was also highly skewed.

    The moment I reached office, everyone including non Singaporeans was asking me about 1MDB and the missing money. Just imagine the power of PR propaganda.

    Business Times also wrote on the same issue, but was much more objective and measured. No attempt to spin the story.

Ltd. (GIC) – during the past four decades? Why workers today are not allowed to fully withdraw their CPF savings at 55 yrs of age? Why Singapore is so supportive of the Trans Pacific Partnership Agreement (TPPA)?

      As for the independence of Singapore Straits Times, “World Press Freedom Index” ranks Singapore at a low no.153 out of 180 countries worldwide.

I am not upset with the Singaporeans but just pointing out how the PR propaganda machine is able to exert such influence even beyond the country’s borders while the govt agencies and embassies are just letting it happen.

            1. Not in Selangor, no. They’ve tasted two terms of Pakatan rule and having DAP sit in the Speaker’s chair, and previously hogging Selangor Times.

              In 1999 and 2004, DAP had only two and one Adun respectively in Selangor. Today the party has 15. The Chinese’s anti-establishment attitude has very much hardened over the last decade.

                DAP is part of the establishment in Selangor while Umno is the opposition (no MCA or Gerakan Aduns in S’gor).

                So what I meant by the Chinese’s “anti” attitude is their behaviour such as wearing black in order to boycott the official Adun uniform and songkok recently at Perak assembly as well as other disrespect/hostility shown to Malay customs and Islam with their elevation of Christianity to rival the Religion of the Federation in the government arena and public domain.
